Malaysian Coach Crash Tourists Group Action

Stewarts Law are to represent a group of English tourists injured in a coach crash in Malaysia in a group action against their tour operator, Explore Worldwide Ltd.
Stewarts Law act on behalf of 13 members of a tour party who were injured when the coach in which they were travelling left the road and fell into a ravine. Despite the fact that the accident occurred in Malaysia and the coach driver and coach company were from Singapore, the tourists will be able to pursue their claims in England.
"Many British holidaymakers injured abroad decide not to pursue claims because they consider it too inconvenient to instruct a foreign lawyer and conduct a case in a country thousands of miles away", said Ben Townsend, a partner at Stewarts Law Leeds office. "However, under the Package Travel, Package Holidays and Package Tour Regulations 1992, if they were on a package holiday, they might well be able to sue their UK-based tour operator in the English courts and have their damages assessed in accordance with English law."
