Ground breaking Periodical Payment Order

Following a settlement at a Mediation for one of our seriously injured clients Stewarts Law have now finalised a ground breaking Periodical Payments Order.

In addition to a seven figure lump sum, periodical payments for care linked to ASHE 6115, periodical payments for earnings linked to the relevant occupational classification of ASHE, this Order is thought to be the first to provide for periodical payments for future medical treatment and therapies indexed to the Hospital and Community Health Services Index (HCHS).

Julian Chamberlayne, a Partner at Stewarts Law with the conduct of this case commented "this case has the broadest range of periodical payments known to any of the lawyers involved in it to date. Those periodical payments are indexed in ways which should give the Claimant tax and risk free annual payments to meet his long-term future needs".

In Court when making the final Order Mrs Justice Swift commented that the periodical payment issues were "uniquely complex and difficult".
