Lives on the Line - Fighting for Fairness

Stewarts Law is pleased to be a part of the Lives on the Line campaign to promote the fair treatment of all injured service personnel by amending the Armed Forces Compensation Scheme so it applies to everyone injured after 11 September 2001.

It's manifestly unfair that a soldier seriously injured just prior to the April 2005 changes will not be compensated, while a soldier injured immediately after will, despite the fact that both fought in the same conflict and made the same sacrifice.

Stuart Dench, Partner at Stewarts Law, added:

"In recent months I have met with a number of soldiers seriously injured in Afghanistan and Iraq. A number of those soldiers were injured before 6 April 2005 and were therefore not entitled to any compensation from the Armed Forces Compensation Scheme. A soldier injured on the 4 April 2005 will not be compensated, a soldier injured on 6 April 2005 will, despite the fact that both fought in the same conflict.

One of our clients Corporal Mick Brennan was horrifically injured in a suicide bomb attack in Iraq in November 2004. As a result of the blast he lost both of his legs and suffered neurological injury. He was injured 6 months before the AFCS was introduced so will not be compensated unless the law is changed. Had he been injured after 6 April 2005 he would have received £230,000 of immediate financial support."
