Record Periodical Payment Award for Injured Cyclist

On 10 June 2009 Mr Justice MacDuff gave his Judgment for a 54 year old Stewarts Law's client in his claim against an uninsured motorist. Shortly before the Trial Julian Chamberlayne, a Partner at Stewarts Law, had agreed with the Defendants for Periodical Payments in respect of our client's extensive care and case management needs in the annual sum of £260,000 which will riseannually in line with inflation for carers' pay. This is the highest reported Periodical Payment of its type to date. Our client has a high level tetraplegia as a result of this tragic accident when an uninsured motorist knocked him from his bicycle on a Devon country lane back on 7 June 2003. He now requires 24 hour care with 2 carers assisting him for some parts of the day and night. For the remainder of his losses, the Judge awarded £2.137 million. The total award, including the periodical payments has a value which is likely to considerably exceed £7.5 million.

At a further hearing on 18 February 2010 Mr Justice MacDuff granted permission for the Court of Appeal to consider the additional awards of interest and costs in our client's favour consequent to an offer which he made to settle his claim back in May 2006 and which he subsequently substantially bettered.
