Antitrust Litigation
An effective private actions system will enable consumers and businesses to obtain redress where they have suffered loss...this will have positive effects on the productivity and competitiveness of the UK economy. Chairman of the Office of Fair Trading
We specialise in antitrust and EU disputes.
Our department is headed by Jonathan Sinclair who has many years' experience and is widely regarded as a leading expert in competition and antitrust litigation.
Our primary focus is on competition related litigation including the resolution of compensation issues that arise as a result of competition infringements.
In addition to damages claims resulting from cartels and abuse of market dominance we deal with the UK and EU regulatory authorities, advising on warranty claims or similar issues arising from antitrust infringements and with other disputes involving international trade or EU law.
Our lawyers have substantial experience in conducting cases in the European Court of Justice as well as in the UK Courts. We have strategic partnerships in place with litigation firms in the EU and United States enabling our clients to adopt an international perspective when enforcing or seeking to resolve competition and antitrust issues.
We evaluate the prospects of each case at the outset and provide straightforward advice on the merits and legal cost issues. Our aim is then to conduct matters speedily but thoroughly and, at key stages, to assess both the financial and commercial implications of the case.
We consider litigation as one of a number of options available for resolving commercial disputes. We recommend mediation or negotiation if there is sufficient common ground. The swiftest route to a satisfactory resolution of a case can often be found in strong reasoned argument based on careful preparation. However we will take firm action and pursue proceedings incisively where our clients' situation demands it.
