International travel and foreign jurisdiction cases are handled by a specialist team within the Personal Injury Department.
We act for clients who have been seriously injured abroad and provide expert advice on issues of jurisdiction and applicable law. The team acted for the Claimant in Harding v Wealands, a landmark decision of the House of Lords that established that the assessment of damages would be according to English law even though the accident occurred overseas.
The law relating to both liability and the level of damages recoverable varies from country to country. In each case we will provide expert advice on the most appropriate jurisdiction in which to bring a claim. In some cases we advise that proceedings are brought in the United Kingdom. In others, we advise that the case is filed in a foreign court.
We have strategic partnerships in place with a number of foreign law firms and are therefore able to assist our clients with effectively pursuing cases abroad.
The team is led by Julian Chamberlayne who has litigated a number of very significant travel law cases for those who have been seriously or fatally injured in travel accidents.
