Our dedicated tax litigation specialists can assist clients with all their contentious tax issues which may include reclaiming overpaid tax, procedural disputes (e.g. the expiry of statutory time limits), judicial reviews in circumstances where HMRC have behaved unfairly or beyond the remit of their authority and negotiating settlement agreements. We can also assist in situations where HMRC disagree with or misunderstand the factual circumstances of our clients' businesses.
Head of Department David Pickstone, previously of PricewaterhouseCoopers Legal LLP, has vast experience of acting for large corporates, financial institutions and High Net Worth Individuals in tax disputes before the Tax Tribunals, High Court, Court of Appeal, Supreme and European Courts. David has worked on many of the most important recent tax cases, including having conduct of the Prudential privilege litigation from the High Court through to the Supreme Court, acting for Littlewoods Retail Ltd in their claim for compound interest on overpayments of VAT and acting as the lead solicitor for the Stamp Taxes Group Litigation Order.
Our lawyers are trained accredited mediators and they embrace alternatives to the traditional tribunal/court process where it is appropriate and economical to do so. We understand that tax disputes are often different to other commercial disputes in that there will be an ongoing relationship which needs to be maintained between HMRC and the taxpayer. However, our lawyers have extensive experience of fighting and winning cases in the First-tier Tax Tribunal, Upper Tribunal, Appellate and European Courts when it is in our clients' best interests to do so.
