Response to the Rail Accident Investigation Branch (RAIB)’s interim report into the circumstances of the Bedford Rail Crash published 1 October 2026.

Stephanie Clarke, Partner in the Personal Injury practice comments:

“The role of the RAIB is not to determine blame or liability but to investigate the technical issues behind the crash and to identify measures that could help prevent similar accidents in the future. They will have looked, for example, at the signalling systems, maintenance procedures, driver training and other operational factors which may have contributed to the crash.

“Today’s report suggests there may have been a problem with the automatic warning system on the train and human error was likely a factor in the incident. These are important findings for the rail companies and network providers at the centre of the Bedford incident. They also help personal injury lawyers like me representing victims as we seek to learn the reasons for their injuries. For injured passengers and bereaved families, of course, understanding what happened can be a critical part of the process of coming to terms with an event that has had a profound impact on their lives. Today offers some answers although notably today’s report is interim and not the final conclusions of the RAIB.

“For those involved in the crash, the road to recovery can be long and challenging. While some people may be coping with serious physical injuries, others may be experiencing psychological trauma, anxiety or post-traumatic stress. Families can also face uncertainty around employment, loss of earnings and financial security as well as future care and support needs.

“My team has been instructed by a passenger and their family involved in the Bedford crash. Our role is to advise on the investigation process, access to rehabilitation and medical treatment, and the options available to them as they consider potential claims.

“While attention today is naturally on the technical and operational causes of the collision, we will be supporting our clients to translate the RAIB report into the meaningful aspects for them and the implications of it for their potential claims.

“We will be emphasising that this is very much an interim report and that the investigation continues with the British Transport Police and Office of Rail & Road who are also investigating the potential criminal and regulatory issues respectively. Nevertheless, today’s report is very valuable and an important milestone.”
