A married couple who sustained traumatic brain and orthopaedic injuries after being hit by a car while walking towards a car park, have secured a settlement of almost £3.3m from the driver’s insurers.

Background

Our clients, Peter and Susan, a married couple who worked in professional design roles, were walking on a pathway towards a car park when a vehicle crashed into them. They were both immediately taken to John Radcliffe Hospital.

Susan sustained orthopaedic injuries and a severe traumatic brain injury. After being put into an induced coma and undergoing multiple procedures, she was only discharged after nine months. Her husband Peter sustained less severe orthopaedic injuries, but was diagnosed with a traumatic brain injury after ongoing cognitive difficulties with concentration, memory, and fatigue.

How Stewarts were able to help

Stewarts secured early interim payments through a collaborative process with the defendant team, allowing Peter and Susan to access early rehabilitation and case management support.

In Susan’s claim, we secured £300,000 within three months of being instructed. In addition to assisting with both clients’ rehabilitation, we gathered the evidence necessary to show the profound impact the collision had on them. As a result, we were able to secure almost £3.3m in compensation for Peter and Susan through a joint settlement meeting that took place within three years of the collision.

Rehabilitation

Access to early specialist rehabilitation support has enabled Peter and Susan to make remarkable recoveries from their serious injuries. Susan’s rehabilitation included occupational therapy, physiotherapy, personal training, and speech and language therapy. Peter’s rehabilitation included neurorehabilitation, psychology, medical/audio-vestibular input and physiotherapy.

Client testimonial

Peter says:

“I would also like to express my sincere thanks to everyone involved in achieving this outcome. It is clear that a great deal of thought, care and hard work has gone into maximising my wife’s recovery. The generosity and professionalism is greatly appreciated and has certainly not gone unnoticed.

“Looking back over the negotiations, it is evident that every reasonable effort has been made to secure the best possible outcome for my wife and I. We have always felt that the team has acted not only with great skill, but also with genuine care for my wife and our family throughout this long and difficult journey.”
