Ireland’s courts are embarking on remote hearings for the first time in response to the COVID-19 pandemic and Fiona Gillett was able to draw on recent experience to give some insight into the challenges they may expect to encounter.

In this podcast, Fiona and barrister Ali Malek QC speak to McCann Fitzgerald partner Audrey Byrne on what they learned from their involvement in the case of National Bank of Kazakhstan and the Republic of Kazakhstan v The Bank of New York Mellon, Anatolie Stati and others [2020] EWHC 916 (Comm).

The podcast looks at the legal parameters for virtual hearings including ensuring that justice is public, practical issues arising in a virtual courtroom and how to manage them, and also considers broader issues such as access to justice and visibility of cases for virtual hearings.

We partnered with Lexology to share practical advice following our experience of running the first virtual trial in the Commercial Court. That webinar can be accessed here.

Judgment has been handed down in this trial and a report on that can be found here.
