Alejandro Garcia is a London-based international arbitration lawyer with more than 20 years’ experience representing companies, investors, individuals and sovereign states in complex commercial and investment treaty disputes.
He acts as counsel and advocate in high-value arbitrations conducted under the ICC, ICSID, LCIA, SCC and UNCITRAL rules, as well as in other institutional and ad hoc proceedings. He also advises on public international law matters and arbitration-related court proceedings.
Alejandro is particularly recognised for his work in investor-state arbitration, including disputes arising under bilateral investment treaties, free trade agreements and the Energy Charter Treaty. His cases frequently involve multiple jurisdictions, legal systems and languages, with significant experience of disputes connected with Europe, Latin America, Africa, the Middle East, Asia and the CIS region.
Alongside his counsel practice, Alejandro sits as an arbitrator. He is included on the LCIA database of arbitrators, the CIETAC Panel of Arbitrators, the HKIAC Panel of Arbitrators for intellectual property disputes and the WIPO Arbitration and Mediation Center list of neutrals.

Alejandro acts as counsel, advocate and arbitrator in complex international commercial and investment treaty disputes, as well as related public international law and arbitration-related court proceedings. He represents companies, investors, individuals and sovereign states in arbitrations conducted under the ICC, ICSID, LCIA, SCC and UNCITRAL rules, together with other institutional and ad hoc procedures.
With more than 20 years’ experience, Alejandro has advised on disputes across Europe, Latin America, Africa, the Middle East, Asia and the CIS region. His practice spans a broad range of sectors, with particular experience in energy and natural resources, infrastructure, telecommunications, technology, life sciences, financial services and foreign investment disputes.
Alejandro is an experienced advocate who regularly leads oral hearings in high-value commercial and investor-state arbitrations. He has conducted cross-examinations of factual and expert witnesses and presented complex arguments on jurisdiction, liability, causation and quantum.
He is particularly recognised for his work in investment treaty arbitration, including disputes arising under bilateral investment treaties and the Energy Charter Treaty, and has acted for both investors and states in some of the most significant investor-state disputes of recent years.
Alejandro also advises on third-party funding in international arbitration, having secured funding for substantial claims and advised clients on the strategic and practical considerations arising from funded proceedings.

Career and qualifications
Alejandro has practised in London since 2007 at leading international law firms, including Herbert Smith Freehills. Before joining Stewarts in 2022, he was a partner at Clyde & Co.
He is admitted to practise in England and Wales, New York and Chile. He also has Higher Rights of Audience in civil proceedings in England and Wales.
Alejandro holds an LLM from Harvard Law School, where he was a Fulbright Scholar. He obtained his LLB from the University of Chile, receiving his degree with Distinción Máxima, the university’s highest academic grade.
Publications, speaking and teaching
Alejandro writes and speaks regularly on international commercial arbitration, investment treaty arbitration and public international law.
He is co-author, with Trevor Cook, of International Intellectual Property Arbitration, published by Kluwer Law International. The book was the first comprehensive English-language work on the use of international arbitration to resolve intellectual property disputes. A second edition is in preparation.
Alejandro also lectures on commercial and investment treaty arbitration. He is a Visiting Professor on Pepperdine Caruso School of Law’s International Commercial Arbitration Programme in London, where he teaches the course’s investment treaty modules.
Experience
International commercial arbitration
- Representing a UAE company in a Seoul-seated ICC arbitration against one of Asia’s largest manufacturers of household appliances, arising from an exclusive distribution agreement governed by UAE law. The tribunal awarded approximately $110 million to the client
- Representing a European company in an LCIA patent arbitration against one of the world’s largest pharmaceutical companies, involving Belgian contract law, intellectual property, competition law and complex scientific evidence
- Advising an international car manufacturer on substantial claims against a European supplier arising from a series of development contracts subject to English law and LCIA arbitration in London. The claims concern contractual performance, confidentiality and intellectual property
- Representing a Latin American company in an English law ICC arbitration concerning the defective design and supply of a specialist water recirculation system by a European company, securing a multimillion-dollar award for the client
- Representing the claimant in a multimillion-dollar, Paris-seated ICC arbitration concerning the catastrophic failure of a generator used in combined-cycle electricity generation following defective repair works by a European engineering company.
Investment treaty arbitration and public international law
- Representing claimants in an investment treaty arbitration against a Latin American state concerning the seizure of productive assets used in the offshore oil and gas sector, with claims exceeding $800 million
- Representing a UK national in an ICSID arbitration against a Latin American state arising from measures affecting investments in the offshore oil and gas sector
- Representing claimants in three related ICSID investment treaty arbitrations against a West African state arising from the termination of offshore oil and gas exploration and production licences. The proceedings were resolved through a favourable settlement
- Representing the claimant in an ICSID arbitration against Italy under the Energy Charter Treaty, arising from an investment in the solar photovoltaic sector
- Representing a Western European state in UNCITRAL proceedings brought by international investors under the Energy Charter Treaty, concerning regulatory measures allegedly affecting investments in the solar photovoltaic sector
- Representing a US investor in an investment treaty arbitration under CAFTA-DR against a Central American state, arising from the termination of an oil and gas licence and the seizure of the relevant premises.
Arbitration-related litigation
- Representing a Chinese conglomerate and its Chilean subsidiaries in English High Court proceedings arising from the approximately $1 billion acquisition of a Chilean salmon-farming business. The proceedings included an application under section 9 of the Arbitration Act 1996 based on an arbitration agreement governed by Chilean law
- Acting for a European state in English court proceedings challenging an investment treaty award under sections 67 and 68 of the Arbitration Act 1996
- Pursuing proceedings in a Scandinavian country against an insurer following a successful ICC arbitration and an award in favour of a Latin American company.
Arbitral appointments
- Sitting as co-arbitrator in an LCIA arbitration seated in London and governed by English law
- Sitting as sole arbitrator in a WIPO dispute between European and Latin American parties concerning a film and governed by Mexican law
- Sitting as sole arbitrator in a WIPO media dispute involving copyright issues and governed by Mexican law.
