Stewarts represented Mr Ibrahim, a UK national, who was struck by a vehicle in 2019 while attempting to cross a pedestrian crossing in Zaventem, just outside of Brussels, Belgium, during an overseas work trip. This cross border dispute was due to proceed to a 10-day quantum trial in March 2026.

Background and injuries
As a consequence of the collision Mr Ibrahim suffered an array of injuries, including a tear to the ligament in his right knee, a head injury and injuries to his neck, shoulder, arm and back. He was unable to return to his work and was further diagnosed with psychological trauma and depression.
Working life was a central part of Mr Ibrahim’s identity, and his career as an aircraft engineer was something he had dedicated most of his professional life to achieving. The accident has not only had a profound impact on his mobility, but he has also faced the difficult reality that he is unlikely to return to the work he loved or achieve his career aspirations.
Legal proceedings
Mr Ibrahim initially instructed other solicitors. However, after establishing that the previous solicitors did not have the expertise to deal with a cross-border litigation case like this, Mr Ibrahim transferred his case to Stewarts.
Attempted “torpedo” jurisdiction challenge
Stewarts issued proceedings against the defendant, AXA Belgium, in 2024. Following receipt of a defence which made no mention of any intention to challenge jurisdiction, AXA Belgium, commenced a separate set of proceedings in Belgium, issuing a personal writ of summons on Mr Ibrahim and arguing that a miscommunication between themselves and its UK agents resulted in a lack of knowledge that the legal proceedings had commenced.
AXA Belgium made an application to the High Court for a stay of proceedings in the UK, arguing that it was not the appropriate forum for the case to be heard and requesting a relief from sanctions for missing the 14-day deadline to challenge the jurisdiction. Ultimately, Stewarts was successful in defending the applications, with both dismissed by Master Fontaine (sitting in retirement).

Settlement
With an upcoming 10-day trial in March 2026, the parties agreed to attend a mediation, in an effort to settle the claim outside of the Court.
Sarah Prager KC of Deka Chambers, represented the Claimant at the mediation, which was facilitated/mediated by Paul Russel KC of 12 Kings Bench Walk. The Defendant was represented by Bernard Doherty of 39 Essex Street.
Following a lengthy mediation process where both sides showed a willingness to take a collaborative approach to settle, the Claimant’s claim was settled for a six-figure sum.
The mediation process undoubtedly played a vital role in helping the parties reach agreement on the day. Paul Russel KC’s ability to quickly grasp the complexities of the case, clearly highlight its strengths and limitations, and foster cooperation between the parties proved crucial to achieving this outcome.
