Of dual British and Peruvian heritage with proficiency in Spanish and Italian and experience in assisting international mining companies across multiple jurisdictions, Rafaella has a nuanced understanding of cross-cultural communication and the intricacies of navigating diverse legal frameworks.
She has assisted on matters covering all aspects of arbitration, including commercial arbitration and investment treaty arbitration pursuant to the rules and procedures of major institutions, including ICSID, ICC, LCIA, DIAC and UNCITRAL, and on arbitration-related litigation mandates before the English High Court.
Prior to joining Stewarts, Rafaella worked at a corporate consulting and mining investment company assisting the boards of LSE- and ASX-listed exploration and development companies in the jurisdictions of England and Wales and Western Australia.
Experience
- Representing two Central American investors against one of Latin America’s largest countries in a US$400m+ bilateral investment treaty claim under the rules of ICSID and UNCITRAL
- Assisting in a section 67 and section 68 challenge before the English courts to set aside the enforcement of a bilateral investment treaty award
- Acting for a Nigerian oil and gas company in consolidated ICC arbitrations against a consortium of lenders arising out of a US$1bn+ financing of an onshore oilfield interest
- Advising on a DIAC arbitration, DIFC anti-suit injunction and section 9 proceedings before the English courts.
Career
Rafaella read Spanish and Italian at University College London (UCL) before obtaining the Graduate Diploma in Law, Legal Practice Course and Master of Laws (LLM) with distinction. Rafaella worked in the corporate mining sector before training and qualifying at Stewarts.
