Emma McCall has produced a guidance note for the Lexis PSL platform about how to challenge lifetime dispositions when dealing with an estate.

When someone passes away, beneficiaries and personal representatives of an estate often have concerns about dispositions made by the individual during their lifetime.

The guidance note covers a number of bases upon which lifetime dispositions may be challenged such as the deceased lacking capacity, being subject to undue influence or the requirements for a valid deathbed gift not being met.

In this note, Emma outlines the options available and gives guidance on how challenges can be successful.
