How is an injury claim is calculated

There are three parts of a compensation claim following a serious injury:

  • An award for the injury itself – a sum to compensate the claimant for their pain and suffering and to reflect the fact they may live the rest of their life with a disability.
  • Past losses – the losses and expenses a claimant incurs as a result of their injury, between the date of their injury and the conclusion of their case: loss of earnings, care costs, expenses relating to accommodation, transport, rehabilitation, therapies, equipment and so on.
  • Future losses – the losses and expenses a claimant is likely to incur as a result of their injuries for the rest of their life.

How and when will I receive injury compensation?

While it can take a number of years to be able to accurately assess how much compensation a claimant should receive, Stewarts works hard to secure interim payments for our clients. Interim payments can be used to fund rehabilitation, pay for care, purchase a house or buy equipment while the claim is still being resolved. At the end of the case, it is possible for the final compensation award to be paid in one large lump sum or, alternatively, a smaller lump sum plus ongoing annual payments. Our lawyers will advise clients on what the best option is for them, having taken the time to get to know them and their individual circumstances.
