What will affect how long an injury claim takes?

  • The client’s needs: Our lawyers will usually only advise clients to settle a case when we have evidence about their long-term needs and when we are confident it’s the best possible outcome for them. How long it takes to assess those long-term needs will be a major factor in the timeline of the claim and this will differ for each individual.
  • The defendant’s stance: While the person or organisation at fault for the injury (and/or their insurer) may accept liability immediately, there is no guarantee that they will do so. Usually, the sooner liability is admitted, the sooner the claim can conclude.
  • The type of claim: How the person sustained their injury will also affect timings. Medical negligence claims often take longer than other types of claims, because of the nature of the expert evidence that is required to prove the case.
