Commercial Disputes

The following is a selection of the cases we have worked on:

  • Advising an Asian automotive manufacturer in its defence of claims arising out of a failed joint venture valued in excess of US$700m.
  • Advising on coverage of a US$250m claim arising from a catastrophic explosion at a petrochemical processing plant in the Gulf of Thailand.
  • Advising an Asian government in English court proceedings defending a section 67 challenge to an UNCITRAL tribunal’s dismissal of jurisdiction under a bilateral investment treaty.
  • Advising a leading pharmaceutical multinational in LCIA proceedings against an Asian pharmaceutical exporter in claims valued at c. US$30m.
  • Advising a number of Asian institutional investors in both the RBS and Tesco securities litigation in the English Courts.

Private Client Disputes

  • Advising a well-known family on a dispute over a trust structure worth over US$20bn involving one of the largest business conglomerates in Asia. After securing a landmark Privy Council victory for our client which clarified the proper purpose rule, we continued to lead on the matter through a ten-day Bermuda Court of Appeal hearing.
  • Advising a client on the implementation of a pre-nuptial agreement in relation to assets c. £400m and interests in a substantial family business in Southeast Asia.
  • Advising a client on a dispute involving a US$1bn structure and the high-profile divorce of an ultra high net worth settlor. We produced a 150-page trust “stress test” report setting out the potential vulnerabilities of the structure and providing various solutions to mitigate these.
  • Advising a client in a cross-border divorce and financial remedy case involving assets c. US$2bn.
  • Advising a client on a dispute involving a US$500m estate. The team navigated culturally sensitive family dynamics and conflicting legal frameworks to protect our client’s interest in the midst of a dispute involving the capacity of the now deceased settlor.

Litigation costs and funding

If assistance in financing a dispute is required, we offer expert guidance on a multitude of options for litigation funding. These creative solutions encompass securing external funding for significant cases, exploring insurance coverage, implementing conditional fee agreements and providing fixed or capped fees where appropriate. We have now acted in more than 2,000 disputes for nearly 4,500 clients and have recovered well in excess of £2bn in damages using alternative funding arrangements of one or more forms.
